Terms and Conditions of the ERGO 1 Online Store

1. Definition of the Online Store

The ERGO 1 online store (hereinafter also referred to as the "e-store") is an online platform specializing in the sale of office chairs, gaming chairs, interior furnishings, and ergonomic everyday items, such as accessories enhancing work and relaxation comfort. The e-store operates at www.ergo1.eu and offers both standard and personalized products made to the Customer's individual order.

2. Definitions

In accordance with these Terms and Conditions and applicable Polish law, in particular the Civil Code (Journal of Laws 1964 No. 16, item 93, as amended) and the Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended), the following terms have the following meanings:

  • Customer/Buyer: A natural person over 18 years of age with full legal capacity, a legal entity, or an organizational unit without legal personality granted legal capacity by law, making purchases in the ERGO 1 e-store. A natural person making a purchase unrelated to business or professional activity is considered a Consumer under Article 22¹ of the Civil Code.

  • Seller/ERGO 1: ERGO X SPACE Sp. z o.o., with its registered office in Milanówek, ul. Podgórna 34, 05-822 Milanówek, entered in the National Court Register under KRS number: 0001161281, NIP: 5291860269, REGON: 541159894, share capital: PLN 5,000.00, fully paid, conducting commercial activities through the e-store.

  • Product: Products offered in the e-store, including office chairs, gaming chairs, interior furnishings, and other ergonomic items, both standard and made to the Customer’s individual order.

  • Individual Order: An order for a product tailored to the Customer’s specific preferences, e.g., choice of non-standard materials, dimensions, or other features.

  • Withdrawal from the Contract: The Consumer’s right to cancel a distance sales contract within the period specified in these Terms and Conditions, pursuant to Article 27 of the Consumer Rights Act, without stating a reason. Pursuant to Article 38(3) of the aforementioned Act, this does not apply to products made to individual orders.

3. Operator

The e-store is operated by ERGO 1: ERGO X SPACE sp. z o.o., with its registered office in Milanówek, ul. Podgórna 34, 05-822 Milanówek, entered in the KRS under number 0001161281, NIP: 5291860269, REGON: 541159894, share capital: PLN 5,000.00, fully paid.

5. Rules for Using the E-Store

5.1. Only persons of legal age with full legal capacity may make purchases in the e-store.

5.2. Using the e-store, including registration and placing orders, requires providing personal data and consenting to its processing by ERGO 1 in accordance with the Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR).

5.3. The Customer is obliged to use the e-store in a manner consistent with the law, principles of social coexistence, and these Terms and Conditions.

6. Placing Orders

6.1. Orders can be placed via www.ergox.space or by phone at +48 507509506.

6.2. Each product in the e-store is described, including features, materials, gross price (including VAT), and approximate availability.

6.3. The Customer selects the product, quantity, and, for individual orders (e.g., “BLUE BIRD” series), specifies preferences such as weight, height, or non-standard materials. Individual orders are subject to special return rules (see point 9.12).

6.4. Order placement process:

  • Select product and optional configuration, click “Add to Cart.”

  • Option to add more products (“Add More”) or proceed to checkout (“Checkout”).

  • Provide an email address for order status updates, click “Place Order.”

  • Fill in the form with address details, Customer information, and optionally a phone number, click “Continue.”

  • Select delivery and payment method.

  • Confirm the order by completing payment and selecting delivery. After placing the order, the Customer receives a confirmation with the order number via email.

6.5. Failure to select a payment method, interrupting payment, or unsuccessful payment results in the order being deemed unplaced, meaning no contract is concluded, and the order is not processed.
6.6. The Customer is obliged to verify receipt of the order confirmation email. In case of non-delivery or doubts, the Customer should immediately contact the Seller. Failure to do so may result in the order not being accepted.
6.7. The Seller reserves the right to contact the Customer (via email or optionally phone) to obtain additional information or correct data necessary for order fulfillment.

7. Pricing

7.1. Prices in the e-store are quoted in Polish złoty (PLN) and are gross prices (including VAT).

7.2. The total order cost includes the product price and delivery cost, depending on the chosen method.

7.3. The price displayed at the final stage of order placement is binding for the Customer and Seller, regardless of subsequent price changes, promotions, or sales, subject to point 8.5.

7.4. The Seller reserves the right to update prices, introduce new products, promotional offers, or sales.

8. Order Cancellation or Correction

8.1. Order cancellation is possible before the status changes to “Accepted for Production” or “Accepted for Shipping,” subject to point 

8.2. Cancellation is fully free of charge if reported within 2 business days of placing the order.

8.3. Cancellation of an individual order accepted for production requires a written request from the Customer and results in a 30% deduction from the refund amount.

8.4. Order corrections should be reported immediately. The Seller will make every effort to accommodate them where possible.

8.5. Corrections to orders during production or shipping may incur additional fees for changes in materials, dimensions, etc.

9. Withdrawal from the Contract

9.1. The Consumer has the right to withdraw from the sales contract without stating a reason within 20 days from the day the Consumer or a designated person (other than the carrier) receives the product, pursuant to Article 27 of the Consumer Rights Act.

9.2. Non-Consumer entities (e.g., entrepreneurs) may withdraw from the contract within 3 business days after prior agreement with the Seller.

9.3. To withdraw, the Customer submits a clear statement to the Seller in one of the following forms:

  • By mail: ERGO 1 Europe Sp. z o.o., ul. Podgórna 34, 05-822 Milanówek,

  • By email: office@ergo1.eu,

  • Via the return form available in the e-store.

9.4. The 20-day period is met if the statement is sent before its expiry.
9.5. In case of withdrawal, the Seller refunds all payments to the Consumer, except delivery costs, within 3 days of receiving the statement, subject to point 9.7.
9.6. Refunds are made using the same payment method used by the Customer, unless the Customer agrees to another form of refund agreed individually.
9.7. The Seller may withhold the refund until the product is received and verified.
9.8. The returned product must be sent to: ERGO 1 E-Store Service Center, ul. Podgórna 34, 05-822 Milanówek, within 3 days of reporting the withdrawal. The Customer bears the shipping costs.
9.9. The Customer may use a paid return option (courier) or a free option (drop-off point) if the Seller offers such a service at the time of withdrawal. The cost of paid shipping is deducted from the refund amount.
9.10. The Customer is responsible for any reduction in the product’s value resulting from use beyond what is necessary to verify its features and functions, pursuant to Article 34(4) of the Consumer Rights Act.
9.11. Individual Order Products:
Pursuant to Article 38(3) of the Consumer Rights Act, products made to the Customer’s individual order are not subject to the statutory right of withdrawal.

10. Product Availability and Inability to Fulfill Orders

10.1. If a product is available in stock, its description includes the note “In stock, quantity: xx.”

10.2. Some products are available only for individual orders, particularly pre-sale products or special configurations, with the note “Individual order, production time: xx” in the product description.

10.3. In rare cases, such as simultaneous orders by multiple customers, a product may become unavailable. The Customer will be notified as soon as possible of the inability to fulfill the order.

10.4. If a product is out of stock or the order cannot be fulfilled for other reasons, the Customer will be notified by email or phone. In exceptional, justified cases, ERGO 1 may refuse to conclude a sales contract for the company’s safety.

10.5. If delivery to the designated location is impossible due to reasons beyond the Seller’s control (e.g., unavailability of the chosen drop-off point or exceeding permissible package dimensions), ERGO 1 reserves the right to use the billing address or another alternative address provided during order placement to fulfill delivery.

11. Delivery Rules and Order Fulfillment Deadlines

11.1. Delivery of ordered products is available only within the territory of the Republic of Poland. For orders outside Poland, the Customer must contact ERGO X SPACE to arrange details individually.

11.2. Ordered products are shipped within 7 business days unless they are currently out of stock or made to individual order, in which case the shipping time is extended by the duration of production and logistics processes.

11.3. For online payments, the order is processed only after the full payment is credited.

11.4. During periods of increased sales, such as sales or special promotions, delivery times may be extended due to reasons beyond the Seller’s control.

11.5. Order transport is handled by a professional courier company selected by ERGO 1 ensuring reliable and timely delivery.

11.6. ERGO X SPACE reserves that, in case of unforeseen circumstances such as logistical difficulties, technical limitations, or other sudden complications, the order fulfillment time may change, and the Customer will be notified as soon as possible.

12. Conclusion of the Sales Contract

12.1. The contract is concluded in Polish.

12.2. Information on the website www.ergo1.eu does not constitute an offer to conclude a contract under the Civil Code, meaning, among other things, that the Seller may refuse to conclude it in justified cases.

12.3. The contract fulfillment deadline depends on the product chosen by the Customer, its availability, and the preferred delivery method. ERGO 1 undertakes to ship the product or make it available for personal pickup within 7 business days of order placement, as per point 6. Exceptions apply to out-of-stock products or those made to individual order, where the fulfillment deadline is extended by the duration of production and logistics processes.

13. Complaint Procedure

13.1. The Seller is obliged to deliver products free of physical and legal defects.

13.2. The Seller is liable for product defects if identified within two years from the date of delivery to a Consumer Customer.

13.3. In case of a product defect, the Customer may request a price reduction or withdraw from the contract unless the Seller  replaces the defective product with a defect-free one or remedies the defect. This limitation does not apply if the product has already been replaced or repaired by the Seller, or if the Seller has failed to replace the product or remedy the defect.

13.4. A Consumer Customer may, instead of the Seller’s proposed defect remedy, demand replacement of the product with a defect-free one or, instead of replacement, demand defect remedy, unless the Customer’s chosen method of restoring compliance with the contract is impossible or incurs excessive costs compared to the Seller’s proposed solution. Excessive costs are assessed based on the value of a defect-free product, the nature and significance of the defect, and potential inconveniences to the Customer from an alternative solution.

13.5. The reduced price should be proportional to the ratio of the defective product’s value to the defect-free product’s value.

13.6. The Customer may not withdraw from the contract if the defect is insignificant.

13.7. In case of a product defect, the Customer may demand replacement of the product with a defect-free one or defect remedy.

13.8. The Seller may refuse the Customer’s request if the chosen method of restoring compliance with the contract is impossible or requires excessive costs compared to another available solution. For entrepreneurial Customers, the Seller may also refuse replacement or defect remedy if the costs exceed the sold product’s value.

13.9. A complaint should include: Customer details (name and surname), defect description with detailed explanation, photos of the defective product if possible, and the preferred method of restoring compliance with the contract. The complaint should be sent to: email: office@ergo1.eu, ERGO 1 E-Store Service Center, ul. Podgórna 34, 05-822 Milanówek, Poland.

13.10. A Customer exercising warranty rights must deliver the defective product at the Seller’s expense to: ERGO 1 E-Store Service Center, ul. Podgórna 34, 05-822 Milanówek.

13.11. The Seller will process the complaint promptly, no later than 14 days from receipt, and send a response to the Customer’s designated address or via another chosen method.

13.12. If the complaint is accepted, all costs related to the complaint procedure, including shipping costs, are borne by the Seller.

13.13. The complaint procedure complies with the Civil Code of 23 April 1964, in particular Articles 555¹–576 regarding warranty for defects.

13.14. The Seller excludes warranty liability for sales contracts concluded with entrepreneurs.

13.15. The Seller makes every effort to ensure the complaint process is efficient and respects the Customer’s rights, ensuring clear communication at every stage.

14. Payment Methods for Orders

14.1. Cash on Delivery: Available only for orders delivered to the Customer’s specified address.

14.2. Online Payments: Processed by an external partner, Stripe Payments sp. z o.o., with its registered office at ul. Waryńskiego 3A, 00-645 Warsaw, REGON: 520642121, NIP: 7011062474, KRS: 0000937028.

14.3. Available online payment methods: debit/credit card, PayPal, Klarna, BLIK, Przelewy24.

14.4. Customer data used in the payment process is processed by payment operators in accordance with the privacy policies of Stripe, PayPal, Przelewy24, BLIK, and Klarna.

15. Final Provisions

15.1. These Terms and Conditions are available at www.ergo1.eu and may be amended by the Seller. Amendments do not affect orders placed before their entry into force.

15.2. Matters not regulated herein are governed by the Civil Code, the Consumer Rights Act, and other applicable Polish laws.

15.3. Any disputes between the Customer and the Seller will be resolved amicably, and in the absence of agreement, by the competent common court. Consumers may use out-of-court dispute resolution methods, e.g., the ODR platform (http://ec.europa.eu/consumers/odr/).
